Political Science Essay

The adoption of the US Constitution has been accompanied with many scandals as well as the issues and ideas that have been contrasting among the participants of the Constitutional Convention. This legal document was rather political considering the role that it played in the history of the USA. It practically connected the states that opposed to one another few months before. The adoption of the list of the fundamental rights might have also become a stumbling stone for the framers. Therefore, the adoption of the Bill of Rights was postponed (Burchard, 2006). Yet, the non-inclusion of it into the text of Constitution does not mean that these rights are not constitutional. They are equaled to the ones provided directly by the text of Constitution. The supplementation of the Bill with the latter amendments also does not mean that the following rights are less important. The legal documents are frequently amended due to the need of times and, therefore, some of the rights are stipulated a little bit later. In some cases, the legislators need more time to debate on the issue and incorporate it into the body of law in the way that will not be detrimental for the citizens of the USA.

The only difference that might relate to the status of the rights protected by the Bill of Rights and the Amendments passed later relates to the less developed court practice which might require the lawyers to establish the new precedents and to challenge the rules or interpret the norms in a different ways. Yet, such a difference is only a matte of time; therefore, it is irrelevant when assessing the possible impact it might have on the scope of protection of one’s right.
